About hospital authority approvals

Approval to supply pharmaceutical benefit medicines can be granted to a hospital authority in accordance with section 94 of the National Health Act 1953External link (the ACT) (ComLaw website - Attorney General's Department).

An approval granted under section 94 of the Act enables the hospital authority to supply pharmaceutical benefits to patients receiving treatment in or at the hospital (i.e. supply cannot be made to visitors or staff).

If the hospital authority operates more than one hospital campus, located at different addresses, then a separate application is required in respect of each campus.

Applications for approval

The person/s making the application on behalf of the governing body or proprietor of the hospital must provide evidence that they are authorised to make the application. The applicant/s must also declare that the dispensing of drugs and medicinal preparations at the hospital will be performed by, or under, the direct supervision of a registered medical practitioner or pharmacist.

A participating public hospital can access:

  • PBS subsidised medicines for:
    • outpatients
    • patients on discharge from hospital
  • chemotherapy drugs for day patients

Relocation of a hospital

If an approved hospital authority relocates the hospital to new premises then a separate application is required in respect of the new premises, as there is no provision to relocate a section 94 approval.
